All content available on this website and within the Octate platform (collectively, the "Service"), including but not limited to text, graphics, logos, icons, images, software, and other materials, is the exclusive property of Octate Software L.L.C. or its respective licensors and is protected by applicable copyright and intellectual property laws.

Except as expressly permitted by Octate Software L.L.C. in writing, no content from the Service may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, modified, or used to create derivative works in any form or by any means.

2. Trademark Notice

The name "Octate" the Octate logo, and all related names, logos, product and service names, designs, and slogans are trademarks or registered trademarks of Octate Software L.L.C. in the United Arab Emirates and/or other jurisdictions. All other trademarks, service marks, and trade names appearing on the Service are the property of their respective owners.

You may not use any of the aforementioned marks without prior written authorization from Octate Software L.L.C or the respective trademark owner.

3. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. Octate Software L.L.C makes no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Octate Software L.L.C. does not warrant that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components. Any reliance you place on the Service is at your sole risk.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Octate Software L.L.C., its affiliates, officers, directors, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

Octate Software’s aggregate liability for any claim related to or arising under this agreement shall be limited to the total amount paid by the customer for use of the ERP platform during the twelve (12) months preceding the claim. Force Majeure events will release both parties from liability.

5. Arbitration Clause

Any dispute, claim, or controversy arising out of or in connection with these Legal Notices, or the use of the Service, shall be resolved exclusively and finally through binding arbitration under the rules of the Dubai International Arbitration Centre (DIAC) or any other relevant arbitration institution in the United Arab Emirates (UAE). The arbitration proceedings shall be conducted in Arabic, and the seat of arbitration shall be Dubai, United Arab Emirates. The arbitral award shall be final, binding, and enforceable in any court of competent jurisdiction.

6. Governing Law

These Legal Notices, and any disputes arising out of or in relation to them or the Service, shall be governed by and construed in accordance with the applicable laws of Dubai, United Arab Emirates, without regard to its conflict of law principles.
